In the event the weather on the day of your experience is deemed unfit by the operator you will be given the option to reschedule your experience free of charge for another time, or you may request for the full amount to be transferred onto a SLC Gift Voucher. SLC Gift vouchers are valid for three years from date of issue. Sydney Luxury Cruise does not offer cancellations and/or refunds on issued Gift Vouchers. Sydney Luxury Cruise does not offer refunds on Private Charters that have been cancelled or rescheduled due to weather or other unforeseen circumstances.

Having been refitted in 2014, OSCAR II is a stunningly designed yacht, styled by Lexcen Lowe Yacht Design. OSCAR II boasts a foredeck jacuzzi, an oversized swim platform, sundeck barbecue as well as spacious areas for al fresco dining, sunbathing, fishing or simply enjoying the incredible views as the yacht takes guests around Sydney and The Whitsundays. The luxury does not end with the interior, however. Once inside the yacht, guests will be greeted by sumptuous styling throughout. The interior is spacious, airy and features contemporary styling. With a cruising speed of 12 kts and a top speed of 15 kts, MY OSCAR II is perfectly fitted out to take guests exploring the oceans around Australia. MY OSCAR II features one master cabin, one VIP cabin and one bunked cabin. All cabins are spacious and come fully equipped with WIFI, multi-zoned surround sound, air conditioning, iPod connectivity and satellite TV. The luxury and sense of space extends beyond the cabins to the rest of the interior, with state-of-the-art surround sound and a home theatre. MY OSCAR II also features a formal dining table that can seat up to ten guests as well as a grand saloon and galley. The three crew will ensure that guests have the perfect vacation and MY OSCAR II comes equipped with snorkelling equipment as well as a Seadoo, allowing guests to explore the ocean when they are not relaxing aboard the stunning yacht. MY OSCAR II is the ultimate yacht for anyone wishing to enjoy true luxury while out on the open ocean

Terms & Conditions for Oscar 2

TERMS AND CONDITIONS OF CHARTER

DEPOSIT: A charter is only confirmed upon receipt of a 50% deposit BOND: A bond of $3000 in form of a credit card authorization must be paid 24 hours before the charter date. The bond will not be repaid in the event of: - Breach of charter conditions - Loss or damage to the vessel or fittings - Unruly behaviour - Causing the Master (captain) to terminate the charter early in concern of the safety of other passengers, crew and the vessel

CANCELLATION: Deposits are non-refundable, except in the condition where more than 30 days prior we are successful in rebooking the vessel at your scheduled charter date and time. Cancellations between 30-10 days will forfeit the deposit. Cancellations less than 10 days prior will require costs to be paid in full, with consideration given to staffing, food and boat costs associated with cancellations. CATERING: Final number of passengers must be confirmed no later than 7 days prior to the charter. Within 7 days of the event, when confirmed by your event coordinator prior, numbers may increase however a decrease in numbers will incur the total cost of the balance invoice issued. Please note that pricing and catering options are subject to change based on seasonal availability. FINAL PAYMENT: Any outstanding invoices including the remaining vessel hire, catering, staff or wharf fees are due 14 days prior to the charter. Additional expenses incurred on board are required to be paid before disembarking. COVID 19 – FREE CANCELLATION POLICY: If COVID-19 restrictions imposed by Government prevent your carter from going ahead as planned, you will be offered either a postponement to another available date within a year, or a full refund. This COVID-19 Cancelation policy must be applied at least 7 days prior to the charter date. Any other reasons due to COVID-19 restrictions do not apply to this cancellation policy and normal terms and conditions apply.This policy comes into place with the following conditions; - The vessels passenger limit has changed due to COVID-19 restrictions, and the passenger limit is lower than the original passenger numbers booked for that charter. - The vessel is not able to operate as a service due to COVID-19 restrictions. USE OF THE YACHT In booking Oscar II, the charterer agrees that

- No more than the specified number of guests in the balance invoice will board the yacht, including prior approval for all outside entertainment, including DJ’s, photographers, waitstaff, chefs etc - Children must be under the control of a responsible adult. That adult is responsible for the conduct and personal safety of the children while on board the yacht. Children are strongly encouraged to wear a lifejacket for the duration of the charter. - Compliance with the Laws and Regulations of the State and Australia.

SWIMMING AND WATER ACTIVITIES All water activities must be prior advised to your event coordinator no more than 48 hours before the charter and are reserved for smaller groups. It is up the captain’s discretion on the day whether guests will be able to engage in water activities/swimming. Additional costs may be incurred. No more than 20 guests are allowed in the water at any one time, unless a lifeguard has been organised prior to charter. The use of the jacuzzi is available with prior request only and is reserved for smaller groups. Towels are to be provided by the guest.

DURATION OF THE CHARTER: Charter time includes the time for passengers to board and disembark the vessel. Additional time required to disembark past 15 minutes will be charged pro rata. If you require earlier access to the vessel for styling and/or pack down, additional fees may apply. Please confirm with your charter manager before arranging with your suppliers. Any items left on board will only be kept for 48 hours, after which time they will be disposed of if not yet picked up.

CHARTER COURSE: The Captain of the charter reserves the right at their own discretion to alter the agreed course because of weather, traffic or any other cause which they believe is justified in the concerns of the safety of passengers, crew and the vessel. RESPONSIBLE SERVICE OF ALCOHOL The vessel operator practices the responsible service of alcohol, and therefore will refuse service to any intoxicated patrons. Offenders with excessive consumption of liquor may be prosecuted for dangerous, rowdy, unruly behaviour as it is against the law.

LIMIT OF LIABILITY: (i) it is a condition of the charter that the liability of the Operator, its servants, agents and sub-contractors is agreed to be limited in accordance with the Limitation of Liabilities and Maritime Claims Act 1989 (Cth) NO SHOE POLICY Oscar II has a strict no shoe policy on board.

What is the maximum capacity of the boat?

The vessel is surveyed to hold a maximum of 64 passengers plus crew. Please note, an infant, regardless of age is considered a passenger. 

Is the boat suitable for children? 

Yes, it is suitable for children, but they must be under adult supervision at all times.

Can we have music on board?

Yes, the vessel is equipped with a sound system where you can plug in a music compatible device like an iPhone. Please ensure your phone or MP3 player is fully charged with battery. 

Where can we go during our charter?

Our professional skipper can take you to most places within Sydney Harbour given that it is within the vessels surveyed boundaries. 

Can we extend our charter time during the charter?

Yes, you may extend your charter time, but this is subject to availability. The charter will be extended based on the decision of the captain on board and payment will be processed post charter by authorised bond or credit card. 

How do I secure my booking?

A minimum of 50% deposit is required to confirm your charter booking, with the balance payable 14 days prior to the commencement of the charter. Should you book your charter within 14 days prior to the date of charter, full payment will be required to confirm your charter booking. Upon payment of your deposit, a Skippered Charter Contract will be emailed to you, confirming details relevant to your charter, which must be signed and returned. 

Is there any paperwork to complete before we go on our charter?

Yes, we require your signed contract and authorised bond form prior to your charter commencing. 

If I cancel the charter, can I get a refund?

We do not offer refunds should you wish to cancel your charter. If boating conditions are unsafe, as determined by the management, we will offer a six month voucher to reschedule your charter based on availability. 

Preparations and Arrival 

It is suggested that you bring a hat, sunglasses, sunscreen, swimmers and a seasonal jacket to the charter as weather conditions can vary on the water. 

Does our party need to get there before the set time of the charter?

All parties should arrive at the designated charter pick up point at least 15 minutes prior to your charter time to allow loading of passengers, and gear and to enable enough time for the skipper's safety briefing. 

Service of Alcohol 

Under the NSW Responsible Service of Alcohol Code we reserve the right to refuse alcohol to anyone deemed to be intoxicated. In the case of BYO charters we reserve the right to limit their consumption and/or to have them removed from the vessel.

Drugs policy 

If we find that charterers are consuming drugs on board our vessels they will be removed from the vessel immediately at their expense and/or and the police will be called.

A former captain of the Bayesian has described the terrifying obstacles facing those trapped in the cabins as the Bayesian superyacht overturned killing seven.

Stephen Edwards, who captained the Bayesian for five years until 2020, told The Telegraph : “Those who stayed curled up in bed were in the worst situation.

“The storm hit hard, placing them in the melee of flying furniture, glass and other items,” he said adding he had spoken to traumatised crew members.

“Inside the cabins, the only way to think of this is that people were lying in their beds one minute, and the next the room was on its side, totally dark, with the door now either in the floor or in the ceiling above.”

It came as divers race to retrieve Mike Lynch’s personal hard drives locked in a safe on the ocean floor, according to reports.

Italian newspaper la Repubblica reported that the tech billionaire, whose clients included MI5, the NSA and the Israeli secret service, didn’t trust confidential documents on the cloud and kept two encrypted hard drives in a safe which now lies 49 metres below sea level.

Former captain says surviving crewmembers all have PTSD from sinking

The former captain of the Bayesian superyacht says he has spoken to all of the surviving crew to hear their account of the sinking.

Stephen Edwards said all the crew members who were on deck rescued as many passengers as they could but that heading down towards the flooded lower parts of the yacht “would have meant certain death”.

The former captain told The Telegraph: “They are not doing very well”

“The dominant feeling is still one of shock from the event. They are dealing with what happened, how it happened and how quickly it happened.”

Bayesian yacht sinking: Banking boss among four victims who ‘suffocated in cabin air bubble’

Four of the victims of last month’s Bayesian yacht disaster died after oxygen ran out in an air bubble on the sunken vessel, it has been reported.

Autopsies over the past few days on four of those who died have revealed an absence of water in their lungs, suggesting they suffocated as the air became saturated with carbon dioxide, Italian publication La Repubblica said.

The outlet reported post-mortems showed four people died from “atypical drowning”, with “no water in their lungs, trachea and stomach”. There were no signs of external injuries.

HP looking to recoup £4billion from Mike Lynch’s estate despite Bayesian tragedy

Hewlett Packard Enterprise (HPE) is making the “difficult decision” to pursue Mike Lynch’s estate for £4billion in the interests of shareholders despite the tech billionaire being killed along with his daughter on the Bayesian superyacht.

Antonio Neri, the former engineer turned chief executive at HPE, told the Financial Times : “Obviously my job as a representative of shareholders is to make the difficult decisions.

“These are difficult decisions. But in the end, we are making decisions in the best interest of shareholders.”

Mike Lynch had been celebrating his acquittal from criminal charges on the superyacht when it overturned in a freak storm.

But HPE intends to pursue damages around an earlier UK civil trial in 2022 which found in favor of HPE’s claim that Lynch and ex-CFO Sushovan Hussain had inflated the apparent value of Autonomy during the acquisition.

Bayesian captain said to be ‘living darkest days of his life'

Three crew members including the yacht’s captain are under investigation, with plans being discussed to raise the yacht from the ocean bed to assist enquiries.

Sources close to New Zealander James Cutfield, 51, the captain , told the Italian newspaper Corriere Della Sera that he is living through the darkest days of his life.

Among those killed were Mike Lynch and his 18-year-old daughter Hannah, who had been due to begin studying at Oxford University in September, the yacht’s chef and four other family friends and associates.

Mike Lynch’s co-defendant died from head injury after being hit by car days before yacht sinking

Mike Lynch ’s co-defendant Stephen Chamberlain died in hospital three days after being hit by a car on a country road, an inquest heard.

The 52-year-old, from Longstanton in south Cambridgeshire, was struck by a blue Vauxhall Corsa travelling between Stretham and Wicken on the A1123 at about 10.10am on 17 August.

Mr Chamberlain, a former vice president of finance at Mike Lynch’s software firm Autonomy, had been out running at the time, his lawyer Gary Lincenberg said.

Coroner Caroline Jones told the inquest in Alconbury that his medical cause of death was recorded as “traumatic head injury”.

Mike Lynch ‘likely died of suffocation’ after running out of oxygen on sunken yacht

British tech tycoon Mike Lynch is likely to have died of suffocation after running out of oxygen, according to a source close to the investigation.

They cited initial examinations carried out on Saturday after the businessman’s body was recovered from the family yacht that sank off Sicily ’s coast last month during a freak weather incident.

Mr Lynch died alongside his 18-year-old daughter, the boat’s chef and four others , who were onboard the British-flagged superyacht Bayesian to celebrate his recent acquittal after a lengthy decade-long legal battle.

Initial results of examinations of Hannah Lynch’s body on Saturday were inconclusive, the source told the Reuters news agency.

Mike Lynch’s yacht was ‘unsinkable’, says boss of company who built boat

Giovanni Costantino, the chief executive of the Italian Sea Group, said there are no flaws with the design and construction of the Bayesian and it is “one of the safest boats in the world”.

The Bayesian, a 184-ft superyacht carrying 22 passengers and crew, was anchored off the port of Porticello, near Palermo, when it disappeared beneath the waves in a matter of minutes after a freak tornado struck.

“The ship sank because it took on water, from where investigators will have to say,” Mr Costantino told television news programme TG1.

He suggested that the sinking was down to a series of human errors.

The CEO said that had the crew shut all doors and hatches, turned on the engine, lifted the anchor, lowered the keel and turned the yacht to face the wind, they would have suffered “zero damage”.

He added that data showed it took 16 minutes from when the wind began for it to sink.

Cartoisio said the tragedy will be even more painful if the sinking was caused by “behaviours that were not aligned to the responsibilities that everyone needs to take in shipping”.

£4billion deal to purchase Mike Lynch’s Darktrace

Darktrace shares are set to stop trading publicly at the end of September, after the company set a timetable for its blockbuster private equity takeover to be completed.

The private equity group Thoma Bravo struck an almost 5.31 billion dollar (£4.3 billion) deal to buy Darktrace in April.

It marks one of the biggest take-private deals for a London-listed company in recent years, and will see Darktrace leave the FTSE 100 on October 1.

Founded in 2013, Cambridge-based Darktrace is a cybersecurity firm best known for using artificial intelligence to scan for hacks and data leaks inside IT networks.

A prominent company in the UK tech landscape, it was among the firms represented at the AI Safety Summit at Bletchley Park in November, where world leaders and major tech firms met to discuss the potential threat of artificial intelligence.

The update comes after Poppy Gustafsson stepped down as chief executive earlier in September amid the takeover.

Ms Gustafsson, who co-founded the business in 2013, will be replaced as chief executive by Jill Popelka, the company said.

Ms Gustafsson helped to set up the Cambridge-based company in 2013 alongside Autonomy founder Mike Lynch.

Mr Lynch, and his daughter Hannah, were among seven people to die after the Bayesian superyacht sank off the coast of Sicily last month.

Professor fears more deaths by ‘medicanes’ after Bayesian tragedy

Professor Yoav Yair, Dean of the School of Sustainability at Reichman University in Israel, told the Mirror that storms dubbed ‘medicanes’ - Mediterranean hurricanes - could cause similar sinkings like the Bayesian superyacht.

He said: “It is not a matter of if this (the Bayesian disaster) will happen again, but rather it’s when and where.

“In the last couple of years we have seen medicanes - which are a new phenomena. These are hurricane-like storms that pack a lot of energy, and create flash flooding, torrential rains, lightning, hail and severe sustained winds. The 2023 “Daniel” medicane destroyed Libya and caused over 30,000 deaths there.

“The sea surface temperature has risen globally and in the Med as well, charging the atmosphere with increased fluxes of water vapor, which means a higher potential for massive storms.”

Fair taxes on private jets and superyachts could have raised up to £2 billion last year to help combat the climate crisis – Oxfam

Fair taxes on private jets and superyachts in the UK could have raised up to £2 billion last year to help generate vital funds for communities suffering the worst impacts of climate change according to figures released by Oxfam today.

Despite being the most polluting way to travel, private jet use in the UK is soaring with the second highest number of private jet flights in Europe last year – behind only France.

The UK is also home to a 450-strong fleet of fuel guzzling superyachts – vessels with immense carbon footprints. These are luxuries that only a tiny fraction of people can afford and allow the ultra-wealthy to pollute far beyond their fair share.

Oxfam is calling on the Chancellor of the Exchequer to increase taxes on climate-polluting extreme wealth – starting with private jets and superyachts. This could help ensure the much-needed finance to tackle the climate crisis is raised in a fair way that protects people on lower incomes and targets those most responsible and those who can most afford it.

Natalie Shortall, Oxfam GB Climate Justice Policy Adviser, said: “While the super-rich continue to pollute at excessive rates, it is people living in poverty – both in the UK and around the world – who have done the least to cause the climate crisis who are suffering the most from its devastating impacts.

“Further steps to better tax extreme wealth are needed to accelerate climate action and fight inequality – increasing taxes on highly polluting luxuries like private jets and superyachts is an obvious place for the Government to start.

“These are the kind of common-sense solutions that are urgently needed to quickly and fairly reduce emissions and raise crucial climate finance – by making the biggest and richest polluters pay.”

With the wealthiest 1 per cent contributing more emissions than two thirds of humanity , Oxfam warns that without fair action, this injustice will only deepen.

Oxfam figures show up to £830 million could have been raised last year by introducing a higher rate of Air Passenger Duty (APD) for private jets and introducing a superyacht ownership tax.

The research also highlights up to a further £1.2 billion of additional revenue could have been raised by taxing private jet fuel, charging Value Added Tax (VAT) on private aviation, as well as taxing private jet landing and departure slots.

Studies from organisations including Green Alliance and Campaign for Better Transport have shown that private jets are currently charged minimal tax compared to their outsized emissions.

Shortall added: “Amid escalating climate breakdown and inequality, it's morally incoherent that private jets pay no tax on fuel at all, while an ordinary person filling up their car does.”

The £2 billion that could be raised from taxing private jets and superyachts exceeds the total climate finance the UK Government provided in 2023 (£1.8bn). Implementing these new taxes could significantly boost the UK's support to those on the frontlines of the climate emergency, which is vitally needed, without impacting low-income communities in the UK.
